Technology transfer: transfer of ownership or right to use part or all of technology from the party entitled to transfer technology to the technology recipient.
Subjects entitled to technology transfer.
Comprise:
– Technology owners have the right to transfer ownership and the right to use technology.
– Organizations and individuals permitted by technology owners to transfer the right to use a technology have the right to transfer the right to use such technology.
– Organizations and individuals whose technology is subject to industrial property but have expired or are not protected in Vietnam have the right to transfer the right to use such technology.
A dossier of registration for technology transfer includes:
a) A written request for registration of technology transfer, clearly stating the commitment of the parties to ensure that the contents of the contract comply with relevant laws;
b) The original or a certified copy of the written agreement on technology transfer; in case there is no written contract in Vietnamese, it must be translated into Vietnamese and notarized or authenticated.
Order and procedures for registration of technology transfer.
Within 90 days from the date of signing the written transfer agreement, the obligor to register the technology transfer shall send 01 dossier to the agency performing the state management of science and technology to apply for the Certificate of registration of technology transfer.
Within 05 working days from the date of receipt of the complete dossier, the competent state management agency in charge of science and technology shall consider and grant the Certificate of registration of public transfer
